ORDER

AMIR MALIK, J.- Sarwar, a brother of Amanat Ali complainant had a dispute of a residential plot with the family of Sharif co-accused. Allegedly over it on 14.3.93 at 9.10 a.m. The complainant family were assaulted by Sharif and his family members and Faiz Ahmad petitioner was also present armed with a Sota. The part attributed to the petitioner is a simple lalkara. The motive part of the story was concerning dispute between the complainant family and the family of Sharif who are Arain by caste while the petitioner belongs to a different brotherhood.

2. Learned counsel for the petitioner has contended that the petitioner had been found innocent along with 8 others, no injury of any sort had been attributed to him. Five of the family members of Sharif were injured including Sharif himself and that due to party faction the petitioner had been falsely involved. He has also pointed out that Yasin mason who was according to the FIR present at the spot took oath on Holy Quran exonerating the petitioner. In the circumstances, it seems that the investigation was prima facie not one-sided or dishonest. For the reasons mentioned above, the case of the petitioner calls for further inquiry. Allowed bail in the sum of Rs. 50,000/-with two sureties in the like amount to the satisfaction of A.C. Norowal. revisions by the competent authorities.
