1. ORDER Khuda Bakhsh A. Kazi (Chairman).--On 10th October 1972, the above* named applicants filed an application under section 34 of L R. O., 1969 against the above-named*respondents in this Court. Alongwith the said application, an application under section 45 of I. R. O., 1969 has been filed against the respondents, whereby the applicants (Management) have prayed to prohibit the continuance of tne strike by the respondents. With this application an affidavit by Abubakar Kapadia, Manager of the Star Textile Mills Ltd., has also been filed. The respondents have filed written statement wherein they contended that the application is misconceived and is against the provisions of law. Explaining further they have submitted that on 16th October 1972 four hired Goondas including the watchmen without any rhyme or reason beat mercilessly one employee namely Ghani of the applicant-Mills and caused injury to his person. The Management protected the Goondas and when the workers of the mill gathered at the Management's office demanding immediate action against the miscreants, the Management further took side of the miscreants and ordered the workers to resume their duties immediately. This was protested by the workers. The Management put a notice on the notice board that the workers had gone on illegal strike. The Management have followed anti-labour policies by indulging in anti-labour activities and by getting Mr. Sher Bahadur General Secretary of the Workers* Union confined in Jail. There was no one who could influence the workers. They deny that they are on illegal strike. They therefore, prayed that the application be dismissed. I have perused the application supported by the affidavit and the written statement. I have heard the learned Representatives of the parties at a very great length. It appears from the written statement filed on behalf of the respondents that the workers were not resuming their duties owing to the reasons shown in their written statement.
2. Whatever the case may be 4 continuance of strike will in no way help either the workers or the Management. Accordingly I prohibit the respondents (Workers* Union) from continuance of the strike if any direct them to resume duty forthwith.
