DECISION This is an appeal against an Award of the learned Presiding Officer of Labour Court No. V, Karachi, dated the 7th of September, 1973, whereby the learned Court dismissed the application of the appellant-Union-filed under section 32 (1) (a) of the Industrial Relations Ordinance of 1969 (hereinafter called the 'Ordinance of 1969').
2. Mr. Wasi Ahmad, the learned Representative for the appellant raised only one point before .me namely that the learned Presiding Officer did not dispose of all the demands of the Union separately. On the other hand, Mr. A. Hafeez, for the respondent contested this submission and stated that the leamed Court has disposed of all the demands though in a general way. The relevant portion of the observations reads as under :-- "The Union has failed to prove how the respondent-Bank has capacity to meet with the demands involving financial implications raised by them. Similarly the Union has also not produced evidence to prove the other non-financial demands such as working hours, Union office, special leave to office-bearers and uniform etc. with reference to the comparable concerns." I accept the contention of Mr. Hafeez. In this connection a reference may be made to the written arguments before the learned Court which is at pages 301 and 302 of the lower Court record. At these two pages the learned Advocate analysed the position of the other Banks compared to the appellant- Bank. It would appearthat the appellant-Union has not produced any evidence of any comparable concern. How the respondent-Bank is able to pay one month's salary as Bonus is surprising. No other point was urged by Mr. Wasi Ahmed. The appeal is dismissed. Appeal dismissed.
