IMAM ALI G. KAZI, J.- The applicant in this case are alleged to have caused injuries by hatchets to 4 persons. Sardar Muhammad Ishaque, Advocate for the Applicants, contends that prima facie the case of the Applicants will not be covered by prohibition contained in Section 497 of Cr.P.C. He further contends that the co-accused, Ibrahim, has already been granted pre-arrest bail by this Court.
2. Mr. Mohammad Zubair Qureshi, Assistant Advocate General Sind, has referred to the final medical certificates issued in respect of all the four injured persons and he states that injuries caused by them are certified to be simple in nature but are on vital parts of body.
3. In view of above facts, the Applicants shall be released on bail pending their trial in the case provided they furnish solvent surety in the sum of Rs. 50,000/- (Rupees fifty thousand) each and P.R. Bond in the like amount to the satisfaction of the trial Judge.
4. In case evidence is brought against the Applicants which may not entitle them grant of bail, the trial Judge will be at liberty to cancel it after giving notice to the Applicants.
