1. ' The allegation against the petitioner is that he alongwith his co-accused while sitting in a graveyard was making preparation for committing dacoity. The police on receipt of information raided them and encircled the petitioner and the co-accused who, managed to escape but one of the co-accused Irian was arrested who was also injured and on his disclosure, the petitioner was arrested. As a consequence thereof, a case under section 399/402/353, P.P.C. And 324, Qisas and Diyat Ordinance read with section 13 of the Arms Ordinance was registered.
2. As far as petitioner is concerned, there is no such overt act attributed to him so as to bring him outside the pale of law allowing the concession bail. He is also a minor. In this view of the matter, I would direct that the petitioner shall be released on bail provided he furnishes security in the sum of Rs,50,000 with one surety in the like amount to the satisfaction of A.C./Duty Magistrate, Lahore.
