1. ORDBR After going through the complaint and the statement of the Complainant under section 200, Criminal Procedure Code, I find that no offence is made out. Nowhere either in the complaint or in his statement, the complainant has made any specific allegation which would constitute an offence either under section 53 or section 62 of the Industrial Relations Ordinance, 1969. He has only made vague allegations of discrimination on account of his being the member of the Trade Union.
2. He alleges that, though he is a skilled worker, he is being paid wages even less than the rate of unskilled worker. But, he has not stated the rate of wages to which he is entitled and the wages he is actually being paid. He complains of the breach of the terms of the Agreement dated 20th December 1969. But, he does not state how the breach has been committed and of what terms and conditions of the said Agreement. Therefore, I find absolutely no merit in this complaint and no ground to issue process against the accused. Consequently, the complaint is dismissed under section 203, Criminal Procedure Code.
