ORDER

' During the night between 4th and 5th of June, 1992, the petitioners alongwith Hashim co- accused took out Mst. Khanai from the house of her father and took her to the Lusson crop situated near the Dera of Hashim co-accused. Then Hashim committed `Zina' with her, while the petitioners kept a vigil at some distance. She raised hue and cry, attracting Muhammad Hussain, Ghulam Hussain and Qadir Bakhsh and the accused ran away. The petitioners were arrested on 7-6-1992.

2. It is argued on behalf of the petitioners that they are real uncles of Hashim co-accused and it was not expected that they would indulge in such an immoral activity, especially when there is no previous enmity between the parties. According to the learned counsel, the petitioners have been found innocent by the police and it has recommended for their discharge.

3. The application has been opposed on behalf of the State but it has been conceded that the petitioners have been placed in column No,2 of the challan.

4. In view of the innocuous role of the petitioners, they are granted bail if they furnish bail bonds in the sum of Rs,10,000 each with one surety each in the like amount to the satisfaction of the Assistant Commissioner/Duty Magistrate, Bhakkar.
