1. Bail is being sought in the case registered vide F.I.R. No,43 of 1-2-1992 under sections 337/B, Q&D/324/34, P.P.C. At Police Station Peoples Colony, Faisalabad to the effect that with a view to securing possession of the shop petitioner conjunctively with two of his brothers namely Muhammad Jamil and Muhammad Saleem all equipped with daggers launched murderous assault on the complainant's brothers Muhammad Sarwar Khan and Mumtaz Akbar injured while they were attending to their business, co-accused Muhammad Jamil pioneering the attack caused a dagger injury on left flank of the former to which the petitioner supplemented three more in quick succession on buttocks as a consequence whereof he collapsed on the ground where he was caused number of injuries by the petitioner and Muhammad Jamil co-accused on various parts of the anatomy while Mumtaz Akbar suffered three injuries at the hands of Muhammad Saleem, the third assailant during rescue operation whcrcaftcr they vanished away and the injured were removed to hospital; where Sarwar Khan sustained hospitalisation for two months and Mumtaz Akbar for a fortnight, contending that the F.I.R. Was lodged with an unexplained delay of 18 hours; both the co-accused having been found to be innocent during the course of investigation were enlarged on bail rendering the prosecution story doubtful; the petitioner has already suffered 9-1/2 months' imprisonment and the trial of the case as yet has not even commenced, which has been opposed by the learned counsel appearing on behalf of the State.
2. ' In view of the contentions urged by the learned counsel, petitioner is allowed bail upon furnishing bonds in the sum of Rs,50,000 with two sureties each in the like amount to the satisfaction of the trial Court.
