ORDER

' A case under section 365, P.P.C., was registered against the petitioner (No,1) with Police Station Civil Lines, Lahore, vide F.I.R. No,311 of 1992, dated the 17th of September, 1992.

2. The allegation against the petitioner is that he had forcibly abducted petitioner No,2 with an intention to kill her.

3. Learned counsel for the petitioners contended that as per the F.I.R. Itself, the complainant herself disclosed that petitioner No,2 was lawfully married to petitioner No,1 when the alleged abductee's father was alive and suffering from cancer. The learned AA.-G. When confronted with this part of the F.I.R. Could not advance any reason why the petitioners could be held guilty of the offence mentioned therein. To cap it all, last but not the least was the petitioner No,2's statement made before me that she had entered into marriage with petitioner No,1 lawfully, and that nobody had abducted her what to speak of forcibly. Therefore, the petition is accepted and the case registered vide F.I.R. No311/92, dated 17th of September, 1992, with Police Station Civil Lines, Lahore is ordered to be quashed.
