1. ' This is an application under section 561-A, Cr.P.C. For the quashment of proceedings pending against the applicant before the learned S.D.M. Liaquatabad, Karachi.
2. ' The brief facts giving rise to the present application are the A.S.I. Raja Lehrasab Khan of Police Station Gulberg, Karachi, submitted report before the S.D.M. Under section 14 of the Sindh Crimes Control Act, 1975, against the applicant inter alia alleging therein that he has no means of livelihood and thrives on extortion. He misbehaves with people and threatens them by issuing threats, and thereby he has made the life of the people living in the Mohallah miserable. Due to his harassm ent no one from the public is prepared to give evidence. In the list of cases six cases are mentioned and latest case is of 1986. Whereas in the list of witnesses, 11 witnesses have been mentioned.
3. ' It has been contended by Mr. Zaidi learned counsel appearing for the applicant, that the allegations are vague and general in nature. That the applicant is not a previous convict and there were no grounds for initiating proceedings against him under Sindh Crimes Control Act.
4. ' Mr. Salaman Ansari learned counsel appearing for the State, has contended that in view of the above circumstances, he has no objection if the proceedings against the applicant are quashed.
5. I have considered the contentions. Admittedly, the allegations made in the application are vague and general in nature inasmuch as no time, date, and place of the acts complained of have been mentioned in the complaint. That there is no allegation that the applicant is a previous convict.
6. Even the result of cases has not been mentioned. Most of the cases are of 1982 and 1983 except one which is of 1986. The provisions of Sindh Crimes Control Act are meant for hardened and notorious criminals. It appears that the learned S.D.M. Has not applied his mind to the facts of the present case and has issued process mechanically.
7. ' I, therefore, allow this application and quash the proceedings against the applicant.
