ORDER

' Through this Constitutional petition under Article 199 of the Constitution of Islamic Republic of Pakistan, the petitioner seeks quashment of F.I.R. No, 115/92 registered against her at the instance of respondent No,2 and father of respondent No,3 under section 10/16 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979.

2. Learned counsel for the petitioner contends that the petitioner has filed a suit for dissolution of marriage against respondent No,2 which is pending adjudication and is fixed for 22-12-1992 and the present F.I.R. has been registered just to harass and humiliate her.

3. On the other hand, learned counsel for the respondents submits that the case is still under investigation and the petitioner has not yet appeared before the investigating officer to record her statement to be dealt with in accordance with law. It is further submitted that at this juncture, no case is made out for quashment of the F.I.R.

4. Without going into the merits of the case, this. petition is liable to be dismissed. However, the petitioner is directed to appear before the investigating officer who shall record her statement and shall act strictly in accordance with law. revisions by the competent authorities.
