1. ORDER Saad Saood Jan (Chairman).--In this appeal the appellant challenges the order of the Civil Services Appellate Tribunal whereby his claim for seniority over Ch. Mushtaq Hussain respondent No. 4 was rejected.' It is not necessary to go into the order of the Civil Services Appellate Tribunal for we consider that otherwise too the appellant is not entitled to succeed in his claim. It may be mentioned that both the appellant and respondent No. 4 joined as Zilladars in the pre-integration Province of the Punjab. If respondent No. 4 is not allowed the benefit of his war service then the appellant was no doubt senior to him as Zilladar as his date of continuous officiation in that post was longer than that of respondent No. 4. The question whether respondent No. 4 was entitled to the benefit of war service is immaterial for the disposal of this appeal. In 1962 the service of the Zilladars was re-organized on regional basis in accordance with instructions contained in the Integration circular of 25-11-1955. Each region was to have its own cadre of Zilladars and the promotions to the posts of Deputy Collectors arising in a particular region were to be confined to the Zilladars of that region alone. The appellant was allocated to Bahawalpur Region while respondent No. 4 got adjusted in Lahore Region. Since each Region was a self-contained and independent unit the pre-regionalisation seniority of the appellant and respondent No. 4 ceased to have any importance. The appellant was promoted as Deputy Collector on 8-3-1967. Respondent No. 4 was promoted as Deputy Collector sometimes in February 1966. Subsequently there was a reshuffling of the territorial limits of the various regions. It so happened that both the appellant and ^respondent No. 4 happened to belong to Multan Region. The seniority of Deputy Collectors inter se is to be determined in accordance with their continuous service as Deputy Collectors. Since respondent No. 4 became Deputy Collector earlier than the appellant he was rightly declared senior to the latter. The learned counsel for the appellant has based his case upon the two explanations appended to the rule of seniority to the effect that if a junior officer gets promoted earlier than the senior officer then unless the claim of the senior officer was also considered at the time when the junior officer was promoted, the senior officer is to retain his seniority. We do not think that these explanations have any relevance to the facts of the present case for these are based on the assumption that both the junior officer and senior officer are eligible for the same promotion post. Here as already pointed out respondent No. 4 was promoted against a post occurring in Lahore Region Since at that time the appellant belonged to Bahawalpur Region he could not be considered for promotion against a post arising in Lahore Region. Thus the explanation in question cannot be invoked here. For the reasons stated above we do not find any force in this appeal which is hereby dismissed in limine. Note: Since Prof. Ashfaq Ali Khan was a Member of the Civil Services Appellate Tribunal whose decision is being impugned before us, he has not participated in the hearing of this appeal.
