' The facts leading to the filing of this Constitutional petition are that petitioner is nephew of one Muhammad Zahid who is in custody of respondent No,2, S.H.O., Police Station Model Town, District Gujranwala. It is alleged in the petition that said Muhammad Zahid is being kept illegally. The registration of case is on account of mala fides when no offence whatsoever is made out. It is further alleged that actually there is dispute between the alleged detenu and respondent No,3, which is of civil nature as they ere partners in a business. A civil suit with regard to the rendition of accounts is also pending at Karachi. Respondent No,3, in order to pressurize the petitioner got this case registered at Gujranwala when Muhammad Zahid is permanent resident of Karachi.
2. I have heard the learned counsel and gone through the police file. A case under section 420/381, P.P.C. Stands registered against Muhammad Zahid and he is on police remand. His remand is to expire today. He is in judicial lock-up. The allegation against him is that he committed the theft of Rs,57,500 and Omega watch alongwith certain files from the office of respondent No,3. Recovery of files and Omega watch has been effected from Muhammad Zahid accused. The case is still at investigation stage. No ground for interference is made out. Petition fails which is dismissed.
