1. ORDBR Saad Saood Jan (Chairman).--The appellant was a Junior Clerk in the office of Deputy Commissioner, Multan in 1969. He was charged alongwith two others with tampering with the record of the Copying Department so as to benefit one Jafar Ali in the matter of limitation for preferring an appeal. An inquiry was held by an Extra Assistant Commissioner into the allegations and the appellant was found guilty. A show-cause notice was served upon him by the Deputy Commissioner Multan, and after his explanation had been considered he was dismissed from service. He preferred an appeal before the Commissioner of Multan Division against his dismissal from service but this too was dismissed. He then approached the Board of Revenue but without any success. He has now come in appeal to this Tribunal. The only contention raised on behalf of the appellant is that the final show-cause notice served upon him by the Deputy Commissioner, Multan, was defective in that it was not'specified therein which of the many major penalties was proposed to be imposed upon him. We do not find any force in this contention. No doubt, the Deputy Commissioner ought to have specifically / mentioned in the show-cause notice the major penalty which was intended to' be awarded to the appellant. But we do not think that this lapse on his part has the effect of invalidating the show-cause notice. It is merely an irregularity which did not in any way prejudice the appellant in his defence, lt may also be mentioned that no such plea was taken by the appellant before the Commissioner in his appeal against his dismissal from service. No other point was taken in this appeal. For the reasons stated we do not find any force in this appeal which is hereby dismissed in Umine.
