ORDER

MOHAMMAD MUNIR KHAN, J.-Through this Constitutional petition Bashir Ahmad petitioner wants this Court to direct SHO, P.S. Mamun Kanjan, respondent No.1 to register case against Muhammad Iqbal and 6 others, respondents No.2 to 8 under sections 10/11 of the Offence of Zina (ENFORCEMENT OF HADOOD) Ordinance, 1979 and under sections 465,466,471,148,149,PPC.

2. Learned counsel for the petitioner submitted that one month before the filing of this petition, respondents No.2 to 8 abducted his sister Mst. Wazir Bibi and thereafter prepared a false Nikahnama on 4.4.1983 although Mst. Wazir Bibi had not married to Muhammad Iqbal respondent.

The SHO, P.S. Mamunkanjan states that the allegations levelled in this petition are totally false. In fact Mst. Wazir Bibi has contracted marriage with Muhammad Iqbal. The SHO further stated that Mst. Wazir Bibi had appeared before the Magistrate on 17.2.1988 and stated before him that she had married Muhammad Iqbal with her consent.

3. I have considered the matter. In the circumstances of the case, I do not feel inclined to direct the police to register case against respondents No.2 to 8. The bonafide of this petition seems to be doubtful.

4. For what has been said above, the petition is dismissed.
