' Appellant was tried by the Special Judge (Customs and Taxation), Karachi and on finding guilty under section 156(1)(8) of the Customs Act, she was convicted and sentenced to undergo R.I. For one year and to pay fine of Rs,50,000 or in default to suffer R.I. For a further period of three months.
Against this judgment, appellant has preferred this appeal.
2. Briefly stated, the case of the prosecution is that on 15-4-1992 at about 8-00 p.m. The appellant was arrested at the departure lounge of Karachi Airport by the Customs Officials on finding one kilogram of 'off white heroin powder' in her brief case.
3. Learned counsel for the appellant has not pressed this appeal on merits. He has prayed that sentence of fine of Rs,50,000 be reduced to Rs,10,000 on compassionate ground looking to the fact that the appellant is suffering from the disease of Aids.
4. Mr. Ikram Ahmed Ansari, learned DA.-G. Has conceded the prayer of the learned counsel for the appellant for reduction of fine. In support of his contention he has relied upon the case reported in 1978 P Cr. L J 633, wherein on the ground of hardship to his family, the sentence of fine was reduced from Rs,40,000 to Rs,10,000.
5. Looking to the fact that the appellant is a patient of Aids and that she has already served out most of the sentence of R.I., which is near completion, and that the learned DA.-G. Has also no objection to the prayer made on behalf of the appellant for reducing the sentence of fine, I reduce the fine from Rs,50,000 to Rs,10,000.
' With the above modification in the sentence of fine, appeal is accordingly disposed of.
