ORDER This is an application under section 36-C of the Industrial Relations Ordinance, 1969 (hereinafter called the Ordinance), for transfer of Application No. 621 of 1972, from Labour Court No. I to any other Court. The grounds alleged by the learned Advocate, Mr. Mirza Abdul Rashid, are three-fold, which has given an apprehension in the mind of the applicants that they will not get justice from the learned Labour Court. The grounds are these :-- (1) That the learned Labour Court on 26th February 1973, dismissed the application of the Union on the ground of non-prosecution in the presence of the Representative of the applicants ; (2) That the learned Labour Court had fixed a number of dates for disposal of the Legal Objections filed by the applicants, but in spite of the fact that so many dates were fixed for disposal, the Court ultimately ordered that it should be disposed of alongwith the, main application ; and (3) That the learned Labour Court closed the case of the applicants without summoning the Registrar of Trade Unions, who had been summoned earlier by the applicants.

2. I have heard the learned Representatives for the parties. I have come to the conclusion that the grounds are such that they can give reasonable apprehension in the mind of the applicants that they will not get justice from the learned Labour Court. In these circumstances, I transfer application No. 621 of 1972, to Labour Court No. IV, Karachi, for early disposal. I am told that the learned Representatives for the parties have filed their written Arguments. If the learned Presiding Officer wishes to hear oral arguments of the learned Representatives of the parties, he can do so on some date that suits him and dispose of the application.
