This application for bail has been moved on behalf of Salamat who stands arrested in case F.I.R.
No.105/90, dated 5-11-1990, under section 10/18 of the Offence of Zina (Enforcement of Hudood)
Ordinance, 1979, registered at Police Station Islamgarh, District Rahimyar Khan, at the instance of Mst. Perveen on the allegation that she wits waylaid by the petitioner and had attempted to commit Zina with her but he could not succeed in his nefarious-- design because of the arrival of the witnesses. During the investigation tile petitioner was arrested on 18-11-1090 and hit, been challaned to Court. His bail plea was declined by the lower Court, hence this application.
2. I have heard learned counsel for the petitioner as well as for the State and perused the record. .
3. Admittedly, the prosecution evidence has since concluded and the case has reached the defence stage. The petitioner is in jail for more than 2 months In order to grant a fair chance to him to defend himself I think he is entitled to grant of bail. In this view of the matter I allow this petition and direct that the petitioner be released subject to his furnishing bail bond in the sum of Rs.10,000 with one surety in the like amount to the satisfaction of Trial Court.
