' Applicant Safdar Zaman, who is detained in Crime No. 496 of 1990, Jamshed Quarters Police Station under Article 3/4 of the Prohibition (Enforcement of Hadd) Order, 1979, applied for bail before learned Sessions Judge (East), Karachi, but without success. He has now approached this Court with the same prayer.
2. ' I have heard Mr. Jawaid Haider Kazmi, learned counsel for applicant and Mr. Salaman Ansari, learned counsel for State. The latter has raised no objection to the grant of bail Ed the applicant.

It is contended on behalf of applicant that the powder of heroin was weighed alongwith plastic wrappers and the possibility that the quantity was less than 10 grams, in such circumstances, cannot be ruled out. It has also been urged that the Mashir of recovery is a stock witness of police and he has acted in 9 other cases as Mashir of recovery of Jamshed Quarters Police Station. There is good deal of force in both these contentions, and I am in agreement with the view taken by learned counsel for the State that the case against the present applicant needs further inquiry within the meaning of subsection(2) of section 497, Cr.P.C. Accordingly, bail is granted to applicant in the sum of Rs.25,000 (Rupees Twenty-Five Thousand only) with P.R. Bond in the like amount to the satisfaction of the trial Court. revisions by the competent authorities.
