Mr. Ahmad Khan Chaddhar and 5 other respondents were tried under various sections of the Pakistan Penal Code on the complaint of Qayyum Iqbal. On the conclusion of the trial, they were acquitted of the charges. While acquitting them, the trial Court directed that complaint under section 211, P.P.C. Be drawn up and sent to the Court of competent jurisdiction for the prosecution of the complainant. Feeling aggrieved from the acquittal of the accused and from the direction given by the trial Court for the prosecution of the petitioner; the petitioner filed Petition for Special Leave to Appeal under section 417, Cr.P.C. In which the leave has been granted today and the petition has been converted into appeal.
2. Learned counsel for the appellant has not challenged the acquittal of the respondents from the charge. His grievance was/is that an order for the prosecution of the complainant/petitioner under section 211, P.P.C. Has been passed without legal and factual justification. Learned counsel for the respondents has decided not to oppose him.
3. After hearing the learned counsel for the parties, I feel that it was not necessary for the trial Court to direct prosecution of the complainant under A section 211, P.P.C. So, the order to this extent is set aside and no complaint under section 211, P.P.C. Will be filed against the petitioner. revisions by the competent authorities.
