The petitioner seeks bail in a case registered through F.I.R. No.102/91, dated 12-6-1991 under section 302/324/34, P.P.C. With Police Station Malka Hans District Pakpattan Sharif for the murder of Mst.
Rabia and causing injuries to Mst. Noor Sain P.W. Mst. Rabia is the mother of the petitioner whereas Mst. Noor Sain injured P.W. Is his sister. Alongwith the petitioner, Manzoor Hussain and Abdul Hameed have also been named as accused persons. Manzoor is the brother of the petitioner whereas Abdul Hameed the third accused is not related to them. The motive attributed to the petitioner and Manzoor Hussain i.e. The two brothers is that they suspected that Mst. Noor Sain their sister having illicit relations, therefore, she was refusing to live with her husband and in this their mother Mst. Rabia deceased was supporting her. The occurrence took place in the mid of night on 16-6-1991. No injury has been attributed to the present petitioner to Mst. Rabia deceased whereas he has been attributed injuries to Mst. Noor SainP.W. Which are simple. The petitioner is behind the bar since 16-6-1991 and the challan has not yet been submitted to the Court.
2. The case of the petitioner falls under section 497(2), Cr.P.C. Fie is allowed bail in the sum of Rs.30,000 (Rupees thirty thousand only) with one a surety in the like amount to the satisfaction of A.C./Duty Magistrate, Pakpattan Sharif. The bail application is disposed of.
