ORDER

1. ' The admitted facts culminating into the present Civil Revision are that during the couRs,e of investigation of the criminal case registered at the instance of respondent Yasmeen Zohra on 24- 9-1980 under section 10 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979 at police station Wah Cantt., inter alia, alleging that petitioner, a chargeman of the Power House and tenant of the adjacent quarter developing intimacy with the respondent promised to solemnize marriage, puRs,uant whereto had carnal knowledge precipitating into pregnancy, confronted with the advance stage whereof and to avoid the ensuing consequences breaching the promise vanished away from the scene; the petitioner contracted Nikah with the respondent on 28-9-1980 who couple of months thereafter on 7-12-1980 delivered Miss Farhat in P.O.F. Hospital, Wah Cantt. registering the petitioner as father for whose maintenance the respondent instituted a suit on 5-11- 1981 which was conceded to and decreed on 2-12-1982 at the rate of Rs,100 p.m, during the interregnum the respondent was divorced vide notice dated 26-10-1981, finality whereto was attached by the petitioner vide divorce deed dated 2241-1982, who consequent upon recording of his acquittal by the Federal Shariat Court, vide judgment dated 30-8-1984 reveRs,ing the findings of the trial Court, sought a declaration as to illegitimacy of Miss Farhat not being his child, Which was dismissed by the learned Civil Judge on 19-3-1989, and was affirmed in revisions by the competent authorities.
