HAFEEZULLAH ISHAQ, MEMBER.-This revision petition is directed under section 13 of the Consolidation of Holdings Ordinance, 1960, against the order dated 12.6.1988 of the Additional Commissioner (Cons), Sargodha Division, whereby he accepted the appeal of respondent No.1.
2. Brief facts of the case are that the Consolidation Scheme of the village Phalhi, Tehsil and District Mianwali was confirmed under section 10(3) of the Consolidation of Holdings Ordinance by the Consolidation Officer on 29.6.1987. The petitioner, feeling aggrieved, filed an appeal in the court of the Collector (Cons) with some delay who vide his order dated 21.2.1988 accepted it and made certain amendments in the wandas of the parties keeping in view the contention of the petitioner that he was deprived of his pre-consolidation land during the consolidation operations. The respondent assailed this order in the court of Additional Commissioner(Cons), Sargodha Division who vide his impugned the appeal and amended the wandas of the parties. Hence this revision petition.
3. The learned counsel for the respondents produced a copy of mutation No.124 of Mauza Phathi, Tehsil and District Mianwali according to which the pettioncr Muhammad Nawaz Khan has sold some of his holding to Mehr Khan s/o Ramzan Khan.
4. The learned counsel for the petitioner did not rebut this factum.

Alienation of holdings during the pendency of litigation regarding Consolidation Schemes without the courts permission affects the rights of the other party adversely and may influence the outcome of the case. Hence it is not encouraged. The instant revision petition has been fatally affected by this act of commission of the petitioner as no meaningful relief can be provided since the scope of making changes in Schemes has been restricted by the petitioner's unilateral action.
The revision petition is, therefore, dismissed.
