1. ORDER Saad Saood Jan (Chairman).--1he appellant is a Naib Tehsildar. His grievance is that officers junior to him have been promoted to the rank of Naib Tehsildar but in his case the promotion to the said rank has been withheld. Now sub-clause (/) to paragraph (b) to the proviso to section 4 of the Administrative Tribunals Act, 1974, clearly states that no appeal shall lie to the Tribunal from an order or decision of a departmental authority involving withholding of promotion. As such, this appeal is misconceived and is hereby dismissed in limine.
