ORDER

1. This revision petition has been filed claiming reduction in the amount of bail bond whereby the petitioner was released on bail on 3-10-1991 by the learned Additional Sessions Judge in a case registered vide F.I.R. No.149/91 dated 22-5-1991 under section 302, Qisas and Diyat Ordinance read with section 34, P.P.C. At Police Station Kamoke, subject to his furnishing bail bond in the sum of Rs.1,00,000 with two sureties in the like amount to the satisfaction of the learned trial Court. Learned counsel for the petitioner has sought reduction on the ground that the petitioner has got no means to furnish/arrange surety in the aforesaid amount as such he is rotting in the jail m spite of the aforesaid bail order.

2. I have heard the learned counsel for the petitioner as well as the learned State counsel. It is apparent from the record that the petitioner is not named in the F.I.R. And his implication in the aforesaid case is only the result of extra-judicial confession. He has been shown empty-handed and no overt act, whatsoever, has been attributed to him even in this extra-judicial confession. In these circumstances, keeping in view the nature of role attributed to the petitioner and other attending circumstances of the case into' consideration, I modify the aforesaid order to the extent that he be released on A bail provided he furnishes bail bond in the sum of Rs.50,000 with one surety in the like amount to the satisfaction of the learned trial Court.
