DECISION ' The circumstances in which this appeal against the dismissal of the petition under section 25-A IRO, arisen are as under:-

2. The petitioner alleges to have been working with the respondent since 1986. He was pressing for certain demands which were being resented by the respondent and since he was not prepared to withdraw the same he was unceremoniously dismissed from service on 11-9-1986.

3. The grievance notice was sent and before there was time enough for the reply, the petition was filed in the Court.

4. The contentions of the petitioner were denied in the Reply Statement filed by the respondent but it is not necessary to dilate on the same in the light of the view taken in the matter.

5. The petitioner was the only witness on his behalf and after his affidavit had been filed as many as 10 to 11 dates for the purpose of cross-examination were given but he never chose to turn up and the petitioner's side was ordered to be closed. Later 2 witnesses of the respondent were examined and cross-examined.

6. The point which stares in the face is, that the petitioner was not tested in cross-examination and without any plausible explanation too. Therefore there being no evidence at all, in support of the petition, it merited dismissal. That is enough to dispose of the petition. The appeal is therefore dismissed.
