DECISION ' Shorn of all details, the circumstances under which this appeal has been preferred are as under:--
2. The appellant was appointed as a Turner in the Agricultural Department on 1-2-1966. Some time later on he was transferred to Nawab Shah, and he seemed to be very unhappy, for being away from the district of his posting and in frustration he had resigned on 30-3-1981. It is said that there was no acceptance. Matters placed on the record are somewhat hazy. The fact all the same remains that he had never been given any posting anywhere or drawn his pay after the month of March of 1981. I have no doubt that the resignation was duly accepted as asserted by the Department.
3. He alleges to have been making representations here and there, but for aught we know, there is nothing on the record.
4. It was also urged on behalf of the appellant that there was a Circular issued by the Government which was in regard to all the employees, about the grant of Pension and Gratuity payable to the employees and their families. Clause (i) of the Circular deals with those who died while in service.
Clause (ii) mentions employees who had put in less than 10 years' service but more than 5 years.
They were entitled to the Gratuity and clause (iii) is in the following words:-- "(iii) Those who left service of their own accord or removed from service due to misconduct will not be entitled to any pension/gratuity."
' Obviously he will be governed by this last clause.
5. Admittedly he had sent the grievance notice as late as 9-4-1990. Patently it is time-barred by years and that is enough to dispose of the matter.
