ORDER

1. The petitioner has applied for post-arrest bail in a case registered wide F.LR. No-121, dated 15-5-1991 under section 302, Qisas and Diyat and 34,P.P.C. At Police Station Alipur Chatha.

2. It is the case of the complainant that the petitioner, who was armed with a Sota alongw;th his two co-accused trespassed into the house deceased Riaz Muhammad was sleeping. Where the Petitioner and his co-accused held Riaz Muhammad from his legs thereupon the co-accused Ghulam Bari fired a shot from his carbine which proved fatal. Learned counsel for the petitioner has argued that the petitioner man of 74 years of age and he has not petitioner been attributed any injury to the I have heard the learned counsel for the parties. The-age of the petitioner has mot been controverted by-the learned counsel appearing for the State. No oven act whatsoever has been attributed to him except t hat he held the deceased from his legs. The main role has been attributed to Ghulam Bar' A co- accused who fired from his carbine at Riaz Muhammad deceased while the latter was sleeping. In these circumstances, keeping age and the' role attributed to him into consideration, I admit the petitioner to bail provided he furnishes bail bonds in the sum of Rs.50,000 with two sureties each in the like amount to the satisfaction of A.C./Duty Magistrate, Gujranwala.
