ORDER

MAHBOOB AHMAD, CJ.-- This petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973 is directed against the delimitation finalized by order dated 30.10.1991 passed by respondent No.1.

2. The facts necessary for the purposes of this petition briefly stated are that delimitation of Union Council, Baroo Tehsil and District Gujrat came up for consideration before the respondents, who have maintained the same as it stood during the last elections.

3. The petitioner, who is a resident of Chak Bhudda falling in electoral unit No.5 filed objections and sought re-constitution of the electoral units. The said objections did not find, favour with the Appellate Authority who rejected the same on 13.10.1991. Feeling aggrieved, the petitioner filed an appeal before the Election Authority who also found the already carved units in consonance with the :principles of delimitation and rejected the appeal by order dated 30.10.1991 hence the present constitutional petition.

4. The learned counsel for the petitioner contended that Chak Bhudda, which has been made a component of electoral unit No.5 is more contiguous to Sarhali Kalan as compared with Bhangrhanwala and therefore the principle of contiguity has not been taken care of while delimiting the electoral units.

We have gone through the record as placed before us and find that the electoral units as carved out during the last elections and maintained for the present elections fulfil the requirements of contiguity and equality of population and therefore, call for no interference. It is the admitted position that Chak Bhudda has a population of 218 whilst the Chak. Bhangrhanwala has a population of 1771 and therefore, by keeping the common population for electoral unit No.4 with a part of Bhangrhanwala and taking the remaining part of Bhangrhanwala with a population of 771 and joining it with Chak Bhudda with a population of 218 makes the population equality absolutely clear.

The learned counsel for the petitioner in order to show dis-jointed placement of Chak Bhudda and Bhangrhanwala referred to an un-certified plan of the district, but from the said plan even we find that the boundaries of Chak Sarhali Kalan, Chak Bhudda and Bhangrhanwala meet at a common place and therefore, it cannot be said that Chak Bhudda is not contiguous with Bhangrhanwala.

7. In view of the foregoing, we find no merit in this petition, which is accordingly dismissed in limine.
