DECISION The appellant was employed as a Chowkidar on a salary of Rs. 85.00 per month by the Pakistan Red Cross Society. On 28th November 1968, he was discharged from service without holding an enquiry or giving any charge-sheet. On the face of it, the appellant could not be discharged without complying with the provisions of Standing Order 15 of the West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance, 1968, but this question can arise only if he can make an application under section 25-A of the Industrial Relations Ordinance, 1969 (hereinafter called the Ordinance). The learned Labour Court rightly came to the conclusion, relying on my decision in , Pakistan Red Cross Society v. Abdul Razzak, that the Ordinance did not] apply to the respondent Red Cross Society. In that case, Abdul Razzak was not satisfied with my decision. He challenged it in , in the High Court of Sind & Baluchistan. In that petition,! the Division Bench observed as under:-- "The Tribunal is, therefore, correct in holding that the application of the petitioner was not maintainable under section 25-A of this Ordinance."
2. My view thus found favour with the High Court. I would, therefore, dismiss the appeal.
