1. IRSHAD HASAN KHAN, J.- In writ petition No.30 of 1991 and Review Application No.29 of 1991, a specific direction was given, to the competent authority, namely, Provincial Selection Board (the underlining is mine) to consider the case of the petitioner for promotion to the post of Professor of Radiology under the provisions of Pakistan Medical Dental Council Regulations, 1979. The Government has not challenged the aforesaid decisions of this Court and, therefore, the same are binding on it. It is an admitted fact that the case of the petitioner was never referred to the Provincial Selection Board and at the level of the Health Secretary, the matter was disposed of vide letter dated 6th August, 1991, that the petitioner is not eligible fot promotion. The impugned letter is ex facie violative of the previous orders passed by this Court. I, therefore, direct the respondent to implement in letter and spirit the orders dated 2-3-1991 passed in writ petition No.30 of 1991 and 11-5-1991 passed in Review Application No.29 of 1991 by this Court, by referring the case of the petitioner to the Provincial Selection Board for considering his case for promotion as Professor, on merits and in accordance with law under the provisions of Pakistan Medical Dental Council Regulations, .1979, within sixty days from today under intimation to the Registrar of this Court.
2. With the above observation, the writ petition is disposed of.
