ORDER

1. It is contended by the learned counsel for the petitioner that on the controversy between the parties, a civil suit has been filed by the petitioner---plaintiff before the learned Civil Court at Lahore. He, therefore, submits that on the same controversy criminal proceedings cannot be initiated by the complainant. Learned counsel maintains that till the decision of the said civil litigation by the learned Civil Court, proceedings before the Criminal Court be stayed. This suggestion of the learned counsel has been accepted by Mr. Akhtar Shabbir and Mr. Irfan Qadir, learned Additional Advocates-General. They, therefore, have no objection to the issuance of such a direction by this Court. No one appeared on behalf of respondent No.2 despite service. He is, thus proceeded against ex parte. In the circumstances, the civil suit titled Wali Muhammad v.

2. Muhammad Tufail etc., pending before Mr. Riaz Ahmad Khokhar, learned Civil Judge, Lahore, shall be decided by him on merits first after hearing the parties as early as possible. In the meantime, the learned Law Officers have no objection if the criminal proceedings before the Criminal Court are stayed. The criminal proceedings shall be taken up after the decision of the civil suit for their disposal in the light of the decision of Civil Court. With this observation, this petition stands disposed of. revisions by the competent authorities.
