GHULAM MUJADDID, J: --It is argued that there being a concurrent finding of the two Courts below with regard to issue No.3, the same could be upset only in exceptional circumstances duly supported by cogent judicial reasons. According to the learned counsel, the High Court did not properly construe Exh. P.1 with special reference to the provisions of the Registration Act and thereby committed an error of law which needs consideration by this Court.
2. Contention is not devoid of force.
3. Leave is accordingly granted. Security Rs. 2,500. Appeal to be made ready on the present record and shall be set down for hearing at an early date.
