' This judgment will dispose of W.P. No, 575 of 1989 and W.P. No, 1086 Of: 1989 which are directed against the same judgment of the Punjab Labour Appellate Tribunal dated 12-12-1988.

Muhammad Ashraf Farooq (hereinafter referred to petitioner) was serving as Officer Grade-III in the Employment of United Bank Limited respondent No,3 when his services were terminated by its Vice-President/Zonal Head (respondent No,4) on 18th January, 1983 on the charge of absence from duty. The petitioner after serving the requisite grievance notice filed an application under section 25-A of the Industrial Relations Ordinance 1969 before the Punjab Labour Court No,4, Faisalabad (respondent No,2) challenging the order of his termination. Two appeals one by the petitioner and other by respondents Nos. 3 and 4 were filed before the Punjab Labour Appellate Tribunal who vide its judgment dated 12-12-1988 dismissed the appeal filed by the respondent bank but partly allowed the appeal of the petitioner and allowed him 50 per cent back benefits. Respondents Nos.

3 and 4 have challenged the dismissal of their appeal by the Punjab Labour Appellate Tribunal by filing W.P. No, 575 of 1989 while the petitioner in W.P. No, 1086 of 1989 has challenged the denial of remaining 50 per cent of the back benefits.

The arguments of the learned counsel for the parties were heard at some length during which the parties arrived at a compromise in accordance with which the respondent bank has agreed not to agitate against the order of Punjab Labour Court reinstating the petitioner in the service while the petitioner has relinquished his claim to the back benefits. Both the parties had agreed that the total period of absence of the petitioner including the period during which the dispute remained pending in Courts is to be treated as leave without pay. This appears to be fair arrangement and in the interest of both the parties is accordingly allowed.

' The writ petitions stand disposed of in the above terms without any order as to costs.
