1. DECISION Mr. Jan present for complainant and heard. Objection filed by Mr. Yaqoob also considered. The only ground taken by Mr. Jan is that accused did not negotiate with the complainant Union on Charter of Demands. I think refusal to negotiate on Charter of Demands does not constitute any offence, and only itsL consequence is that the Union may proceed under section 26(3) of I. R. O.I The word 'shall' used in sections 26(1) and 26(2) of I. R. O. does not mean that the Management is to mandatorily negotiate with the Union and failure to do so would be punishable. The complainant has not made any case and so the complaint is dismissed under section 203, Cr. P. C.
