1. ' According to the learned counsel for the petitioners, his Lordship Mr. Justice A.S. Salam (as his Lordship then was) decided Writ Petition No,125/R of 1975 (Muhammad Iqbal etc. v. Settlement Commissioner etc.) on 27-10-1984 saying that the controversy regarding inheritance of Mst. Noor Bano shall be determined by the learned Settlement Commissioner (Lands). The learned Member, Board of Revenue while deciding the revision moved by Abdul Sattar etc. Observed that the order, dated 5-3-1986 of the learned Collector shall be restored and that the learned Settlement Commissioner, Multan, shall decide the controversy as directed by the Superior Courts. According to the learned counsel, the dispute regarding inheritance of Mst. Noor Bano has already been decided by the learned Settlement Commissioner on 2-1-1991. He, therefore, submits that in substance, the judgment of the High Court has been complied with by the respondents. In these circumstances, learned counsel maintains that this Constitutional petition has become infructuous. Learned counsel for the contesting respondent says that Muhammad Iqbal purchased the land in question from Mehrban, a real brother of Mst. Noor Bano, He, therefore, submits that respondent No,3 has a vested right in the land in question. He states that respondent No,3 shall challenge the mutation having been effected in favour of the petitioners according to law, in case he feels that he has been affected by the said mutation. In view of statement of learned counsel for the petitioners, the petition is disposed of as having become infructuous.
