ORDER

IJAZ NISAR, J.-This order will dispose of bail applications i.e Crl.Misc.20- B/1990 moved by Rehmat Ali etc through Sardar Muhammad Latif Khan Khosa, Adv. And Crl. Misc. No.64-B/1990 moved by Muhammad Mansha through Sardar Munir Ahmad Gill, Advocate. The petitioners alongwith 3 others are charged with the murder of Sanaullah deceased talcing place on 15.4.1988. It is alleged that the murder was committed in conspiracy with three other co-accused.

2. Bail is sought on the grounds that the petitioners had been found innocent in the investigation carried out by Sardar Ali, Inspector/SHO Sharaqpur and D.S.P/S.D.P.O., Sharaqpur. Riaz Ahmad co- accused who was not found innocent is on bail. The part attributed to him in the occurrence is the same as attributed to the present petitioners i.e. General firing. It is next submitted that the dead body has not been recovered.

3. The petitioners are behind the bars since 27.4.1988. In view of the fact that they were found innocent in the investigation a case of further inquiry is made out. Accordingly I admit Rehmat Ali, Nazar Hussain and Muhammad Mansha petitioners to bail in the sum of Rs. 15,000/- with two sureties each in the like amount to the satisfaction of A.C.
