1. ORDER Divisional Superintendent, P. W. R., Multan, has preferred this appeal against the ex parte order dated 19th January, 1973 whereby application under section 25-A of the I. R. O., 1969 filed by Ali Muhammad, respondent was accepted and his L. P. R. was cancelled with the result that he was recalled. Arguments heard. The learned representative of the appellant has contended that appellant was never served and there was no justification for proceeding ex parte against him. I have gone through the file of the lower Court which bears him out. There is nothing on the file to show that any notice was sent to the respondent. Order, dated 19th January, 1973, states that the appellant was reminded on telephone to appear and the message was received by Mr. Khurshid Ahmad, Office Superintendent. This telephonic' communication was not at all sufficient to warrant ex parte action against the appellant. The ex parte order is, therefore, unsustainable. For the foregoing reason I accept this appeal, set aside the order of the Junior Labour Court and the file is sent back to the Junior Court for fresh decision in accordance with law after giving an opportunity to the parties to produce their evidence. The parties are directed to appear before the Junior Labour Court on 10th December 1973. Appeal accepted.
