' This First Appeal is by Muhammad Sadiq (defendant borrower) against the judgment and decree passed by the learned Additional District Judge, Bahawalpur, dated 30-5-1989. By means of this judgment the learned Additional District Judge accepted the application of House Building Finance Corporation under section 30 of the House Building Finance Corporation Act, 1952 (Act XVIII of 1952).
2. Both the parties have settled the matter by means of compromise. Learned counsel appearing on behalf of the Corporation submitted that the accumulated amount to the extent of Rs,93,650 is outstanding against the petitioner-appellant on 30-12-1990; that the Corporation is prepared to receive the amount. In instalments, in following manner:-- Date of Payment. Rs, 30th December, 1990 30,000.
15th June, 1991 30,000.
15th September, 1991 Remaining amount with future interest.
3. Learned counsel for the appellant accepted the offer of the learned counsel for respondents and submitted that this litigation be decided in accordance with the aforesaid terms.
4. In result this FA.Q. Is disposed of. The judgment of the first Court is modified in accordance with the terms indicated above. Muhammad Sadiq, borrower shall make the payment in accordance with the agreed schedule noted above. In case of default the Corporation shall have a right to receive the total amount in lump sum. There shall be no order as to costs. The order of the first Court is accordingly modified.
