1. ' On account of strenuous efforts having been made by Mr. Farooq Bedar, learned Additional Advocate-General, Raja Mahmood Akhtar, Mr. Jehangir A. Jhojha, learned counsel, the parties have themselves resolved their dispute by entering into a compromise regarding the custody of their minor son M. Tariq Kashif aged about 11 years. Respondent No,1 states that he has continuously been depositing a sum of Rs,275 p.m. For the maintenance of his minor son as already ordered by the learned Judge Family Court. He further submits that he will continue to deposit the said amount in the name of minor in the future as well. He agrees that he will open an account in the National Bank of Pakistan in the name of Mohammad Tariq Kashif with a view to deposit the amount in his account. Mst. Shabnam Bano the mother has no objection, if the custody of Mohammad Tariq Kashif is given once in the first two weeks to respondent Sh. Mohammad Saleem on every Friday in the second week to enable the minor to A stay with his father and younger brother for one day.
2. Similarly, it has been agreed by the parties that the other minor Mohammd Tayyab Saleem aged about 9 years, who is presently in the custody of respondent Sh. Muhammad Salecm shall be given on the last Friday once in the last two weeks in a month to live with his mother Mst. Shabnam Bano and his elder brother. This arrangement of exchange of two minors as mentioned above shall continue from morning to evening time till such time, they attain the ages of majority. The amount already deposited by the respondent in the name of the minor shall stand transferred in the account of the minor in the National Bank of Pakistan which shall be opened by the petitioner shortly. With these observations, this petition stands disposed of in the light of the above said compromise between the parties.
