' This petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973 assails the order of the Deputy Commissioner/District Collector Lahore, dated 24th of December, 1990 whereby he transferred the proceedings for grant of maintenance under section 9 of the Muslim Family Courts Ordinance, 1961 from Chairman Arbitration Council Ward No,100 to the Chairman Arbitration Council Ward No,108. The only ground urged by the learned counsel for the petitioner is that the Chairman of Arbitration Council Ward No,108 belongs to Pakistan Muslim League and is a member of the Provincial Assembly and respondent No,2 is his strong supporter. There is, however, nothing on the record to support this assertion of the petitioner. It is also to be seen that when the case was transferred by the Collector from Arbitration Council Ward No,100 to Arbitration Council Ward No,108 no such objection was raised before the Collector. The contention of the learned counsel for the petitioner that though such an objection was raised but was not incorporated in the order of the Collector cannot be accepted in the absence of anything on the record.
Be that as it may if the petitioner has any apprehension that she shall not get justice at the hands of respondent No2 her remedy lies to file an application A before the Collector for re-transfer of the case to some other arbitration council.
