Mst. Fazlan Bibi has prayed for the issuance of a writ declaring &I.R. No.329, dated 15-11-1989 at Police Station Toba Tek Singh, as illegal, not maintainable, without lawful authority and for its quashment.

2. Learned counsel for the petitioner has contended that with respect to the disputed agreement of gift civil suit was already pending in the Court so lodging of the F.I.R. Later on by Muhammad Saeed Akhtar respondent No.3 was uncalled for. The facts of the civil matter and the F.I.R. Need not be discussed at all. The challan has been submitted in Court as admitted at the bar and if the petitioner feels aggrieved, he may move application under section 249-A, Cr.P.C. Normal remedy is available and it must be availed of first. The extraordinary remedy of writ is to be availed only when there is question of jurisdiction involved. Hence the petition is dismissed.
