TANVIR AHMAD KHAN< J. The petitioners have applied for post arrest bail in a case FIR No.156/90 dated 7.7.1990 under sections 307/325/148/149 PPC at Police-Station Batapur, Lahore.

The allegations against the petitioners are that they in the company of co-accused who were armed differently stopped the bus in which the complainant was travelling alongwith her husband Muhammad Ashiq. They dragged complainant's husband out of the bus and fired in the air. It has further been mentioned that the petitioner No.2 Sher Muhammad raised Lalkara that Muhammad Ashiq be taught a lesson for the litigation. Thereupon co-accused inflicted injuries on his person.
Muhammad Ashiq suffered 10 injuries in this occurrence out of which four have been declared grievous.
3. Learned counsel for the petitioners has sought bail on the ground that Sher Muhammad petitioner No.2 has been involved in a malafide manner alongwith his sons. It has further been stated that no overt act whatsoever has been attributed to the petitioners and the injuries allegedly found on the person of the injured were on non-vital parts.
Learned State counsel has opposed the bail.
4. I have considered the contentions. In this case petitioner No.2 alongwith his three sons as well as two other relatives have been implicated. I do not want to dilate upon the contentions of the petitioners on the aspect of malafide nature of the FIR as it may prejudice the case of the prosecution. However, one thing is evident that no overt act whatsoever has been attributed to the petitioners except a proverbial Lalkara to Sher Muhammad petitioner NO.2. The injuries are on the non-vital parts and have not been attributed to the petitioners. In this background I admit the petitioners to bail in the sum of Rs.30,000/- each with two sureties each in the like amount to the satisfaction of A.C/Duty Magistrate, Lahore.
