' This judgment shall dispose of Writ Petitions No,5523/89, 5524/89, 5527/89, 5528/89, 5525/89, 5526/89, 5327/89 and 5328/89 which are directed against the same judgment of the Punjab Labour Appellate Tribunal dated 12-7-1989 whereby he set-aside the order of the Punjab Labour Court No,2 Lahore dated 5-4-1989 and remanded the application under section 25-A of the Industrial Relations Ordinance 1969 to the Labour Court for decision afresh.

In support of these petitions Mr. Ataur Rehman has argued that the finding of the Labour Appellate Tribunal that the respondents are aggrieved persons on account of deduction of Zakat from the final settlement is contrary to law. The other objection raised by the learned counsel Is that the respondents were not workmen within the meaning of Industrial Relations Ordinance, 1969 and the West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance, 1968 and as such the Labour Appellate Tribunal has no jurisdiction in the matter. It is also argued by the learned counsel for the petitioner that the Punjab Labour Court had dismissed the petitions filed by the respondents on the ground that voluntarily retirement scheme did not amount to settlement within the meaning of Industrial Relations Ordinance, 1969 and therefore, any grievance in respect of the same could not be enforced by filing an application under section 25-A of the Ordinance.

Mr. M.D. Chaudhry, Advocate, the learned counsel for respondent No,3 submits that the matter has been remanded by the Punjab Labour Appellate Tribunal to the Labour Court for decision afresh and he has no objection if it is directed that while deciding the matter the objections noted above are also considered and disposed of by the Punjab Labour Court No,2, Lahore. In the circumstances of the case this concession appears to be fair and just.
' As a result of what has been stated above these petitions are disposed of with the observations that it shall be open to the petitioner to agitate all or any of the points noted above before the Punjab Labour Court No,2 and if these questions are raised, the same shall be decided in accordance with law. These petitions stand disposed of. There shall be no order as to costs.
