Petitioner Mehraj Din alias Maja alongwith others was tried by Ch. Muhammad Arshad Virk, Magistrate Section 30, Lahore, for an offence under section 307/34, P.P.C. The learned trial Court vide its judgment, dated 5-7-1982 convicted and sentenced each of the accused to four years' R.I.

With a fine of Rs.2,000, or in default, further R.I. For one year. It was further directed that Rs.2,000 out of the fine, if recovered, be paid to the injured as compensation. The convicts appealed. Syed Muhammad Rafiq Shah, Additional Sessions Judge, Lahore, vide his judgment, dated 7-10-1982, acquitted all the accused, except Mehraj Din, the present petitioner. His appeal was dismissed.

2. Learned counsel for the petitioner, at the very outset, submitted that the parties have compromised and the injured has forgiven the petitioner. Learned counsel for the complainant is also present. He also has stated that there has been a compromise between the parties and he does not wish to pursue the matter anymore. He also prays that the revision filed by him seeking enhancement of the sentence may also be allowed to be withdrawn. Permission to compound is allowed and the petitioner is acquitted of the charge. The criminal revision is accordingly disposed of while relying upon Safdar Ali and others v. The State and another PLD 1991 SC 202.
