1. Juma, son of Ramzan, Sher Muhammad son of Nanak, Abdullah son of Ramzan, Juma son of Abdul Sattar, Ishaque and Ismail alias Pappu were allowed ad interim pre-arrest bail by this Court on 29- 12-1990 in a case registered against them under section 11/16 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979 read with section 14 of the Offences Against Property (Enforcement of Hudood) Ordinance, 1979 and section 379, P.P.C. At Police Station Gogera District Okara vide F.I.R.
2. No.250 dated 13-8-1990. The allegation is that Mst. Suban was abducted by the accused forcibly.
3. Alleged abductee is present in Court. She has made a statement that she was never abducted by anybody and that she had married Muhammad Ishaq, petitioner No5 voluntarily and that she never married Muhammad Siddique. It has been brought to my notice that Mst. Suban is living with her mother Mst. Sohrab Bibi and sister Mst. Zainib Bibi. They are also present alongwith their other relatives. The mother, sister and other relatives do support the statement of Mst. Suban that she was never abducted by anybody. The case of the complainant/father is that Mst. Suban is the legally-wedded were of one Muhammad Siddique. Muhammad Siddique is not present. The Investigating Officer says that he wants to get the sample thumb-impressions of Mst. Suban for their comparison with her thumb-impressions alleged to have been placed by her on the Nikahnama allegedly executed by her and Muhammad Siddique. It appears from the arguments that this is an unfortunate family dispute between the mother of Mst. Suban and her relatives on one side and father of the girl and his relatives on the other side. It is an admitted fact that Mst.
4. Suban has already filed a suit for jactitation of marriage before Judge Family Court, Jhang.
5. Question of valid marriage of Mst. Suban shall be decided by learned Judge, Family Court on the basis of evidence which has to be produced by the rival contenders in the case. In the peculiar circumstances of the case prima facie false implication of the petitioners in a case like this cannot be excluded specially because of the strained relations between' the mother and father of the alleged abductee. Accordingly the ad interim pre---arrest bail already allowed to the petitioners is hereby confirmed. They are directed to join the investigation as and when they are called upon to do so by the Investigating Officer. The bail petition succeeds and is allowed.
2. Learned trial Court is directed to conclude the trial of the civil suit filed by Mst. Suban as early as possible preferably within next two months without fail.
