' This is one of those cases where despite repeated summonses and warrants issued by the learned trial Court, the prosecution witnesses, who are essentially employees of the Police Department, are not entering appearance before the learned trial Court for recording of their statements in a case which relates to . The alleged recovery of Heroin from the accused person.
2. The S.P. (City), Lahore and Abdul Majeed, Inspector/SHO of Police Station, Shandara Town are present in person.
3. The S.P. States that he has taken cognizance of this matter and assures this Court that he shall ensure that, in future, the summonses and the warrants issued by the learned trial Courts are served/executed promptly without any loss of time.
4. I have warned the Police Officers present in Court that in case of any negligence in the service of summonses or in the execution of warrants, the supervisory officers, the S.H.Os. Concerned and the persons to whom these summonses and warrants were addressed for service or execution would be deemed to be guilty of obstructing the course of justice and shall be dealt with accordingly.
5. A mention may also be made of the conduct of the learned subordinate Courts in the matter of securing the appearance of witnesses and accused persons before them.
6. It has been noticed that after issuing the summonses or the warrants, as the case may be, the learned lower Courts do nothing more than merely repeating the issuance of fresh summonses and warrants in case the ones earlier issued are not served or executed.
7. This is not enough.
8. It is directed that in future if the summonses or the warrants, which have been issued, remain unserved or unexecuted till the date fixed for the appearance of the persons in respect of whom the same had been issued, the learned subordinate Courts shall summon the officials/persons to whom the same were addressed for service or execution and record their statements identifying the reasons for the non-service or the non-execution of the process issued and then take appropriate action, whichever is called for, including resort to more coercive processes for compelling the appearance of the persons required to attend the Court and action against the officials concerned, if they are found guilty of malfeasance.

In case the non-service and non-execution of the summonses and warrants persists beyond three opportunities for the purpose, the learned lower Courts shall bring the same to the notice of the District Magistrate concerned and shall also make a reference about the same to this Court for necessary action in the matter.
10. With the above observations and directions, this matter stands disposed of.
11. Copies of this order shall be circulated to all the learned Sessions Judges, District Magistrates and Superintendents of Police, within the jurisdiction of this Court, for information of and compliance by all concerned after this order has been brought to the notice of my Lord the Chief Justice.
