1. The petitioners were tried by Magistrate Section 30, Mandi Bahauddin and convicted him to one year R.I. Under section 354, P.P.C., on 30-9-1980. The convicts appealed which was dismissed by Sessions Judge, Gujrat on 14-1-1981. In the present revision the petitioners impugn the judgments of both the Courts below. The case has been heard in the absence of learned counsel for the petitioners because he failed to appear. I have gone through the evidence with the assistance of learned counsel for the State. The prosecution has mainly proved its case through ocular account furnished by Mst. Sakina bibi and her two brothers. They were put to lengthy cross-examination but the defence could not get any benefit from the cross-examination, which could create a doubt with regard to their testimony. There is concurrent finding given by both the Courts below qua the guilt of the petitioners. In these circumstances, I don't find any illegality or irregularity, which could warrant interference by this Court. The revision is dismissed. However, I have noticed that the occurrence took place in the year 1980 and the petitioners were convicted by the learned trial Court in the same year and ever since then he is facing the hardship of trial. It has been pointed out by learned counsel for the State that the petitioners have undergone more than three months of imprisonment. Since it is an old matter and it will not be in the interest of justice to send the petitioners now to undergo the remaining portion of his imprisonment. Therefore, while dismissing the revision, I reduce the sentence of imprisonment to already undergone by the petitioners. The revision is dismissed.
