1. RASHID AZIZ KHAN, J- The petitioner was convicted to 2 years R.I. and a fine of Rs.30,000/- for an offence under section 409 read with section 5(2) of Prevention of Corruption Act, 1947. He was convicted by Special Judge, Anti Corruption, Sargodha, on 3.6.1990. The main ground agitated by learned counsel for the petitioner for suspension of sentence is that the petitioner is suffering from kidney problems. Report was called and the same has been received and perused. According to the report the petitioner is suffering from kidney trouble and he needs surgery for which no facility is available at jail hospital. Even otherwise also the sentence is short, therefore, the same is suspend and the petitioner is allowed bail provided he furnishes security in the sum of Rs.50,000/- with two sureties each in the like amount to the satisfaction of Assistant Commissioner/Duty Magistrate, Sargodha.
