' Tahir Habib petitioner seeks bail in a case registered against him with Police Station Mumtazabad, Multan, for an offence under section 16 of the Maintenance of Public Order Ordinance, 1960. The allegation. Against the petitioner is that he along with some other students on 23-10-1988 took out a procession from the college and boycotted the classes. They are also alleged to have burnt the tyres and thereby disturbed the traffic on the road. According to the F.I.R., their demand was that they be given free-hand in the examination.
' Learned counsel for the petitioner contends that even if the allegations, as taken in the F.I.R., arc accepted, it was a student organization which in support of their demands had taken out a procession which should not have been given the color of political agitation. Submits that the petitioner was arrested on 3-8-1989, since then he is in confinement.
2. I have heard the learned counsel. According to the F.I.R., the petitioner is alleged to have made a speech and raised slogans along with other students. The contents of the speech as such are neither contained in the F.I.R. Nor have been pointed out by the other side. The petitioner is in confinement for the last more than two months and his further confinement would not serve any useful purpose, especially keeping in , view that he is a student. In these circumstances, the petitioner is allowed bail provided he furnishes security in the sum of Rs,10,000 with two sureties, each in the like amount to the satisfaction of Assistant Commissioner/Duty Magistrate concerned.
